Nvidia has cut more than half of its approved buyers across Asia. It now runs a “white list,” and getting on it means passing an Nvidia audit: staff visiting your data center, verifying your contracts, and interviewing your end users to confirm the business is real (FT and Reuters, July 2026).

Nvidia’s action traces back to a recent change by the agency that administers US export controls. On 31 May 2026, the US Bureau of Industry and Security confirmed that a license is required to ship these chips to any company headquartered in, or ultimately owned by a parent in, China or Macau, wherever that company itself happens to sit. For years, compliance turned on where a chip was going. Now it turns on who ultimately owns the buyer. Many of the companies that were cut have never been accused of diverting anything. They were removed because they could not produce ownership and end-user records that satisfied the new standard.

The increased scrutiny also comes amid heightened enforcement activity in our region. Singapore and Malaysia authorities have investigated and prosecuted cases involving the alleged fraudulent procurement and movement of advanced AI servers, while working closely with international counterparts on export control-related investigations. There have been arrests and prosecutions in both countries, with Malaysia tightening their catch-all controls to cover certain high performance chips.ย The developments underscore that companies operating in Asia should maintain robust customer due diligence, ownership verification and end-use documentation, particularly where transactions involve advanced computing technology subject to foreign export controls.

A failed review is not the end of the road. Companies can reapply with stronger ownership records, data center evidence and end-user documentation. The bar is high, but with the right preparation, companies can get reinstated on the whitelist.
